If you are located in the European Union (EU), European Economic Area (EEA), the United Kingdom, or Switzerland, we rely on one or more of the following legal bases for processing your personal data:

  • Contractual Necessity
     Processing is necessary to provide the Service you request (e.g., account creation, AI appraisals, subscription management).

  • Consent
     You explicitly consent to certain processing activities, such as:

    • Receiving marketing communications;

    • Allowing us to use anonymized images for AI training and model improvement.
       You can withdraw your consent at any time (see Section 7).

  • Legitimate Interests
     We process data as necessary for our legitimate business interests, such as:

    • Securing and maintaining the Service;

    • Improving and optimizing features;

    • Preventing fraud and abuse.
       We balance these interests against your rights and expectations and limit processing accordingly.

  • Legal Obligations
     We may process your data to comply with applicable laws, regulatory requirements, and legal obligations (e.g., accounting and tax rules, responses to lawful requests).

5. Third-Party Services and Data Sharing

We do not sell, rent, or trade your personal information to third parties. We share your data only as reasonably necessary to operate and improve the Service or as required by law.

5.1 Essential Service Providers

We use trusted third-party providers that act as our data processors to support the Service, including:

  • Cloud Infrastructure and Databases
     Secure hosting, storage, and database services (for example, providers such as Hostinger, Coolify, and Supabase) to store your account data, uploaded images, and reports.

  • Authentication Providers

    • Google (for Google Sign-In) – if you choose to sign in with Google, Google shares your name and email with us according to their own privacy policies.

    • Apple (for Sign in with Apple) – if you choose to sign in with Apple, Apple shares your display name and email (or private relay email) with us.

  • Payment and Subscription Providers

    • For purchases made through the Apple App Store (iOS) or Google Play Store (Android), payment processing and subscription management are handled by Apple or Google under their own terms and privacy policies.

    • For purchases made on our website or outside of app stores, we may use Paddle or other payment processors. Paddle handles payment card details and sends transactional emails (e.g., receipts, confirmations) in accordance with Paddle’s privacy policy.

These providers may access your personal data only to perform specific tasks on our behalf and are contractually obligated to protect your data and use it only as instructed.

5.2 AI and Image Processing Services

To provide valuations, we use third-party AI services that analyze your uploaded handbag images to:

  • Identify brands, models, and attributes;

  • Estimate pricing ranges and market demand;

  • Generate structured appraisal data displayed in your reports.

These AI providers process your images and associated metadata solely to perform analysis and return results to us.

By using the LuxPricer image appraisal feature, you explicitly authorize us to send your uploaded images and relevant metadata to these AI providers for one-time analysis in order to deliver your requested valuation.

We contractually require our AI providers not to:

  • Use your images or related data for their own independent purposes, such as training their models, marketing, or resale, unless you have separately and explicitly opted in for AI training as described in Section 13;

  • Share your images with third parties except as necessary to provide the AI service under similar protections.

5.3 Marketplace Data Collection

To build accurate price ranges, we collect publicly available listing data from luxury resale marketplaces such as:

  • Vestiaire Collective

  • Rebag

  • Fashionphile

  • Other similar platforms

We do not share your personal information or uploaded images with these marketplaces. Instead, we only retrieve publicly visible listing information (e.g., prices, condition, model, listing dates) to include in your reports and analytics.

5.4 Business Transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business, your information may be transferred as part of that transaction, in compliance with this Privacy Policy and applicable laws. We will notify you where required by law.

5.5 Legal Requirements and Protection

We may disclose your information if we reasonably believe that such disclosure is necessary to:

  • Comply with a law, regulation, legal process, or governmental request;

  • Enforce our Terms and Conditions;

  • Protect the rights, property, or safety of LuxPricer, our users, or the public;

  • Detect, prevent, or address fraud, security, or technical issues.

6. Data Retention

We retain your personal data only for as long as necessary to fulfill the purposes described in this Policy or as required by law.

In particular:

  • Uploaded Images and Reports

    • Stored in your account history until you delete them or delete your account.

    • If you delete an image or report, it is removed from our active systems. Residual copies may remain temporarily in encrypted backups, which are regularly overwritten.

  • Account Information and Questionnaire Data

    • Retained for as long as your account is active.

    • If you delete your account, we will delete or anonymize your account information and associated profile data within a reasonable timeframe, subject to limited legal retention obligations.

  • Optional AI Training Images (if you opt in)

    • Anonymized images may be retained for as long as needed to improve, validate, and maintain our AI models, unless you withdraw your consent (see Section 13 and Section 7).

  • Server Logs

    • Typically retained for up to 30 days and then deleted or anonymized, unless we need to keep them longer for security investigations or legal reasons.

When we no longer need your data for the purposes described, we will delete it or irreversibly anonymize it.

7. Your Privacy Rights

You have certain rights regarding your personal information. The availability of these rights and how you can exercise them depend on your location and applicable law.

Regardless of where you live, you generally have the following rights:

  • Right to Access
     You can request confirmation of whether we process your personal data and obtain a copy of your data.

     You can update or correct your account and questionnaire information at any time through the App settings or by contacting us.

  • Right to Deletion

    • You can delete individual images and reports from your history.

    • You can delete your entire account, which will result in the deletion or anonymization of your personal data, subject to limited legal retention requirements.

  • Right to Withdraw Consent
     Where we rely on your consent (e.g., marketing emails, AI training opt-in), you may withdraw that consent at any time in your account settings or by contacting us. This will not affect the lawfulness of processing before withdrawal.

To exercise any of these rights, you can:

We may request additional information to verify your identity before processing your request.

7.2 Additional Rights for EU/EEA and UK Users (GDPR)

If you are located in the European Union, European Economic Area, or the United Kingdom, you may have the following additional rights under the GDPR (or equivalent local law):

     You can request that we restrict the processing of your data in certain circumstances (for example, while we verify its accuracy or address an objection).

  • Right to Object

    • You can object to processing based on our legitimate interests, and we will stop processing unless we have compelling legitimate grounds that override your interests and rights;

    • You can object at any time to processing for direct marketing, in which case we will stop such processing.

  • Right to Lodge a Complaint
     You have the right to lodge a complaint with your local data protection authority if you believe we have violated your data protection rights.

7.3 Additional Rights for Swiss Users (FADP)

If you are located in Switzerland, you have rights under the Swiss Federal Act on Data Protection (FADP), including:

  • The right to access, correct, and delete your personal data;

  • The right to object to certain processing activities;

  • The right to restrict processing in certain circumstances.

You may also lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC) if you have concerns about our data practices.

8. Children’s Privacy

LuxPricer is not intended for use by children under the age of 16. We do not knowingly collect personal information from children under 16.

  • If we become aware that we have collected personal data from a child under 16 (or under the relevant minimum age in their jurisdiction) without verifiable parental consent, we will take steps to delete that information as soon as reasonably possible.

  • By using LuxPricer, you confirm that you are at least 16 years old or have reached the age of majority in your jurisdiction.

If you believe that a child has provided personal data to us, please contact us at [email protected].

9. Data Security

We take reasonable and appropriate technical and organizational measures to protect your personal data from unauthorized access, disclosure, alteration, or destruction. These measures include:

  • Encryption of data in transit using HTTPS/TLS;

  • Secure authentication (e.g., hashed passwords, Google OAuth, Sign in with Apple);

  • Use of reputable hosting and infrastructure providers (e.g., Hostinger, Coolify, Supabase);

  • Access controls and least-privilege principles for internal systems;

  • Regular security monitoring and review of server logs.

However, no method of transmission over the internet or electronic storage is completely secure. While we strive to protect your personal data, we cannot guarantee absolute security.

10. International Data Transfers

LuxPricer is operated from Switzerland, and your data may be transferred to, stored, and processed in:

  • Switzerland;

  • Countries in the European Economic Area (EEA); and

  • Other countries where our service providers are located.

When we transfer personal data from:

  • The EEA, UK, or Switzerland to countries that do not provide an adequate level of data protection,

we implement appropriate safeguards, such as:

  • Standard Contractual Clauses (SCCs) approved by the European Commission;

  • Data processing agreements with contractual commitments to GDPR and FADP standards;

  • Reliance on adequacy decisions where applicable.

You can contact us for more information about these safeguards.

11. Device Permissions

To provide core functionality, LuxPricer may request certain device permissions:

  • Camera Access
     To allow you to take photos of handbags directly within the App for appraisal.

  • Photo Library / Gallery Access
     To allow you to upload existing images from your device’s photo library.

You can manage or revoke these permissions at any time through your device settings. Please note that if you deny or revoke these permissions, some features of the App (such as image-based valuation) may not function properly.

12. Marketing Communications

We may send you marketing communications about new features, product updates, promotions, educational content, or other news related to LuxPricer, only if:

  • You have opted in to receive such communications where required by law; or

  • You have an existing relationship with us and local law permits.

You can opt out of marketing emails at any time by:

  • Clicking the “Unsubscribe” link in any marketing email; or

  • Adjusting your email preferences in your account settings (if available).

Even if you opt out of marketing messages, you will continue to receive essential transactional emails, such as:

  • Account verification emails;

  • Password reset emails;

  • Critical service or security notifications.

Payment-related receipts and confirmations may be sent by our payment providers (e.g., Apple, Google, Paddle) and are governed by their own privacy policies.

13. Optional Use of Images for AI Training

By default, the images you upload are used only to generate valuations for you and to show your valuation history. They are not used to train or improve our AI models unless you explicitly choose to opt in.

13.1 Opt-In to AI Model Improvement

We may offer you the option to help improve LuxPricer by allowing us to use anonymized copies of your uploaded images for AI training and evaluation.

If you opt in:

  • We will remove or minimize identifying metadata and decouple images from your account;

  • We will use these images only to train, validate, and improve AI models that power LuxPricer;

  • We will not use these images for advertising or sell them to third parties.

Your ability to use the Service does not depend on opting in, and declining or withdrawing consent will not affect your access to the core features.

13.2 Withdrawing Consent for AI Training

You can withdraw your consent to AI training at any time via:

Upon withdrawal:

  • We will stop adding new images from your account to our training datasets;

  • Where reasonably feasible, we will cease using training images that can be reliably linked to your consent, subject to technical limitations and legal requirements (for example, models already trained on aggregated data may not be fully reversible).

14. Cookies and Tracking Technologies

LuxPricer is primarily a mobile application and does not use web cookies or third-party advertising trackers within the App.

Specifically:

  • We do not use cookies to track your browsing across websites;

  • We do not embed third-party analytics or advertising SDKs for behavioral tracking within the App.

If we introduce any web-based features that rely on cookies or similar technologies in the future, we will update this Policy and, where required, present you with a cookie consent mechanism.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect:

  • Changes in our Service or business practices;

  • Changes in applicable laws or regulatory requirements; or

  • Improvements in how we communicate our data practices.

When we make changes:

  • We will update the “Last Updated” date at the top of this document; and

  • Where appropriate, we will notify you via the App, by email, or by other reasonable means.

For material changes (for example, changes to how we use or share your data), we will, where reasonably possible, provide advance notice (e.g., at least 30 days) so you can review the updated Policy.

Your continued use of the Service after the updated Policy becomes effective will constitute your acceptance of the changes. If you do not agree with the updated Policy, you should stop using the Service and may delete your account.
