LuxPricer – Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of LuxPricer (“LuxPricer”, “we”, “us”, or “our”), an AI-powered application that provides appraisal-style estimates for luxury handbags and related items (the “Service” or the “App”).
By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. About LuxPricer
LuxPricer is an AI-powered mobile application that analyzes images of luxury handbags and generates appraisal-style valuation reports (“Reports”). These Reports may include indicative price ranges, market analysis, comparable listings, and other informational content.
LuxPricer:
- Provides approximate, AI-generated estimates for informational purposes only;
- Does not provide legal, financial, tax, investment, professional authentication, or certified appraisal services;
- Is not a substitute for a professional appraisal, authentication service, or financial adviser.

The Service is made available worldwide via the Apple App Store, Google Play Store, and, where applicable, via our own web-based channels.
2. Definitions
For purposes of these Terms:
- “App” or “Service” means the LuxPricer mobile application and any related websites, APIs, and online services provided by LuxPricer.
- “User” or “you” means any individual who accesses or uses the Service.
- “Free Plan” means the no-cost tier of the Service that provides limited access to features, usage, brands, or Reports, as described in the App at the time of use.
- “Paid Plan” or “Subscription Plan” means any paid tier offered by LuxPricer, including but not limited to the Starter Plan and Pro Plan, each of which provides increased usage limits and/or additional features as described in the App at the time of purchase.
- “Starter Plan” means a paid Subscription Plan designed for moderate usage, offering expanded brand access, listing coverage, and a defined number of Reports per billing period, as described in the App.
- “Pro Plan” means a higher-tier paid Subscription Plan designed for professional or high-volume usage, offering significantly increased or near-unlimited access to Reports, brands, and listings, as described in the App.
- “Report” or “AI Appraisal” means the comprehensive output generated by the App based on your uploaded content, which may include:
- AI-generated market analysis;
- Estimated price ranges based on comparable listings;
- Charts or plots visualizing price distribution;
- Tables of comparable listings;
- Additional descriptive and market information about the handbag.
- “Content” means images, text, and other materials that you upload or submit to the Service.
- “Third-Party Services” means services or platforms not owned or controlled by LuxPricer, including app stores, payment processors, marketplaces, and AI infrastructure providers.
3. Scope and Limitations of the Service
LuxPricer uses artificial intelligence and machine learning models to analyze your uploaded photographs of luxury handbags and generate estimated price ranges, descriptive attributes, and related information.
You acknowledge and agree that:
- All estimates and Reports are informational only and do not constitute:
- Certified appraisals;
- Professional authentication;
- Legal, financial, tax, or investment advice;
- LuxPricer does not guarantee:
- Authenticity of any item;
- Actual resale value or achievable sales price;
- Accurate condition grading;
- Suitability for insurance or lending purposes;
- Estimates may vary significantly based on, among other things:
- Image quality, lighting, and angles;
- Partial or obscured views of the item;
- Rarity or uniqueness of the item;
- Market volatility, regional differences, and time of sale;
- Reports should never be used as the sole basis for purchasing, selling, insuring, or investing in any item.
IMPORTANT: You expressly understand and agree that LuxPricer’s outputs may be inaccurate, incomplete, or unreliable. You should not rely on them as professional appraisal, authentication, or financial advice. For high-value items or decisions involving significant financial commitments, we strongly recommend obtaining an independent, certified professional appraisal and/or authentication.
4. Eligibility
To use the Service, you represent and warrant that:
- You are at least 16 years old (or the minimum age in your jurisdiction required to enter into a binding contract);
- You have the legal capacity and authority to accept these Terms;
- You will use the Service in compliance with:
- Swiss law; and
- All other applicable laws, rules, and regulations in your jurisdiction;
- Any information you provide to us is accurate, current, and complete.
If you do not meet these requirements, you must not use the Service.
5. Account Registration and Security
Certain features of LuxPricer require an account, which you may create using:
- An email address and password;
- Google Sign-In; and/or
- Sign in with Apple.
By creating and using an account, you agree to:
- Provide accurate, current, and complete information during registration;
- Keep your login credentials (including passwords, tokens, and one-time codes) secure and confidential;
- Not share your account with any other person or allow unauthorized access;
- Immediately notify us of any suspected or actual unauthorized use of your account or security breach;
- Promptly update your account information if it changes.
You are solely responsible for all activities occurring under your account. We are not liable for any loss or damage arising from your failure to maintain the confidentiality of your credentials or to secure your account.
6. Plans and Usage Limits
6.1 Free Plan
LuxPricer may offer a Free Plan that allows Users to access the Service with limited functionality.
The Free Plan may include, for example:
- A limited number of image identifications per month;
- A limited number of Report generations per month;
- Restricted access to certain brands, listings, or features.
The specific limits and features of the Free Plan are displayed within the App and may be updated from time to time.
You acknowledge and agree that:
- Free Plan usage limits reset on a monthly basis (or on another cycle specified in the App);
- Unused credits or usage allowances do not roll over or accumulate;
- Once usage limits are reached, certain features may be restricted unless you upgrade to a Paid Plan.
We reserve the right to modify, restrict, suspend, or discontinue the Free Plan (or any of its features) at any time, with reasonable notice where practicable.
6.2 Paid Plans (Starter, Pro, and Other Subscription Tiers)
LuxPricer offers one or more Paid Plans, including the Starter Plan and Pro Plan, each providing enhanced access to the Service.
Depending on the plan selected, Paid Plans may include:
- Higher or near-unlimited image identifications;
- A defined or higher number of Report generations per billing period;
- Access to additional or all supported brands;
- Expanded or full listings coverage;
- Additional features or prioritization, as described in the App at the time of purchase.
The features, usage limits, and pricing of each Paid Plan are displayed in the App or at checkout and may vary by region, currency, platform, or promotional offer.
Automatic Renewal
Unless otherwise stated, Paid Plans are offered on a recurring subscription basis and will automatically renew at the end of each billing period unless canceled before the renewal date.
By purchasing a Paid Plan, you authorize the applicable payment provider to charge the applicable subscription fees and any required taxes.
Fair Use and Reasonable Limits
Where a Paid Plan is described as offering “unlimited” usage, such usage is subject to reasonable and normal use consistent with personal or internal business purposes.
We reserve the right to impose reasonable technical limits, throttling, or restrictions, or to suspend or terminate accounts that engage in excessive, automated, abusive, or unauthorized usage, including attempts to use the Service as a substitute for API access or backend data extraction without a separate agreement.
Plan Changes
We may change the pricing, features, or limits of any Paid Plan from time to time. Where required by law, we will provide advance notice of material changes. Continued use of a Paid Plan after such changes take effect constitutes acceptance of the updated plan terms.
7. Purchases, Billing, and Taxes
7.1 In-App Purchases via App Stores
For subscriptions or purchases made through the Apple App Store or Google Play Store:
- All billing, payment processing, and refunds are handled by the relevant app store, not directly by LuxPricer;
- Your purchase is subject to the terms of service, privacy policy, and refund policy of the respective app store;
- LuxPricer does not collect or store your full payment card details for these transactions.
To manage or cancel a subscription purchased via an app store, you must use your Apple ID or Google Play account settings. Any refunds, where available, are provided in accordance with the app store’s policies.
7.2 Web or Direct Purchases via Paddle
For purchases made outside of app stores, such as via our website:
- Payments may be processed by Paddle or another authorized payment processor;
- The payment processor’s terms of service and privacy policy govern those transactions;
- LuxPricer does not store your full payment card details; sensitive payment data is processed directly by the payment processor.
You are responsible for ensuring that your payment information is accurate and up to date.
7.3 Taxes
Depending on your location, your purchase price may be subject to:
- Value Added Tax (VAT);
- Goods and Services Tax (GST);
- Sales tax; or
- Other applicable taxes or duties.
You are responsible for paying all such taxes associated with your subscription or purchases, unless we are required by law to collect them on your behalf.
7.4 Refunds
We want you to be satisfied with LuxPricer. If you’re not happy with your purchase, you can request a refund within 14 days of purchase, subject to the following terms:
Full Refund Eligibility
You’re eligible for a full refund if you’ve completed 5 appraisals or fewer and request the refund within 14 days of purchase.
Partial Refund
If you’ve completed more that 5 appraisals, you may be eligible for a partial refund at our discretion, calculated based on the difference between your purchase price and the cost of appraisals completed.
No Refund
Refunds are not available for accounts that have completed more than 20 appraisals, as this represents significant usage of our service and associated costs.
How to Request
To request a refund for web/Paddle purchases, contact us at [email protected] with your order details. Refunds are typically processed within 5-7 business days.
For purchases made through the Apple App Store or Google Play Store, you must contact Apple or Google directly to request refunds in accordance with their respective refund policies.
Abuse Prevention
We reserve the right to deny refund requests that appear to be fraudulent or abusive, including patterns of repeated purchases and refund requests.
8. Subscription Management, Renewal, and Cancellation
You may cancel your subscription at any time:
- If purchased via an app store: Use your Apple ID or Google Play subscription settings to cancel before the next renewal date.
- If purchased via Paddle or another processor: Use the cancellation link in your purchase confirmation email, your payment processor’s dashboard, or contact the payment processor’s support.
Cancellation will:
- Stop future billing after the current billing period ends;
- Allow you to continue using Pro Plan features until the end of the current billing period;
- Automatically revert your account to the Free Plan (if available) after the billing period, subject to Free Plan limits and features.
Canceling your subscription does not automatically delete your LuxPricer account. You may delete your account separately through the App settings, subject to our Privacy Policy.
9. User Content and Data
9.1 Ownership of Your Content
You retain full ownership of the Content you upload or submit, including images of handbags and any associated text.
By uploading Content, you represent and warrant that:
- You own the Content or have all necessary rights, licenses, and permissions to use and upload it;
- Your Content does not infringe any third-party intellectual property or privacy rights;
- Your Content complies with applicable laws;
- Your Content does not contain viruses, malware, or other harmful code;
- Your Content is not illegal, defamatory, hateful, or otherwise objectionable.
9.2 License to LuxPricer
To operate and improve the Service, you grant LuxPricer a non-exclusive, worldwide, royalty-free, limited license to:
- Host, store, process, and display your Content;
- Generate and display Reports based on your Content;
- Create temporary copies and derivatives as technically necessary to provide the Service.
This license is limited to what is necessary to operate the Service and to provide you with Reports and related features.
If you opt in to allow use of your images for AI model training (see Section 9.5), you grant us an additional license as described there.
9.3 Storage, Access, and Deletion
- Uploaded images and Reports are generally accessible to you within the App (e.g., via a “History” tab).
- You may view, download (e.g., as PDF), copy, or delete your Content and Reports as provided by the App.
- When you delete Content or Reports, they will be removed from our active systems. Residual copies may remain for a limited time in backups, which are periodically overwritten.
- Deleted Content is not recoverable once it is removed from our active systems. We are not responsible for any loss of Content that you fail to back up.
9.4 Questionnaire and Profile Data
LuxPricer may collect limited profile data (such as name, city/country, and user type, e.g., business, reseller, collector, shopper) via questionnaires to personalize your experience and improve the Service.
You may view, update, or delete this data via your account settings. Certain personalized features may be limited or disabled if you choose to delete or withhold this information.
9.5 Optional Use of Content for AI Improvement
By default, your uploaded images are not used to train or improve our AI models.
If you explicitly opt in, you grant LuxPricer a non-exclusive, worldwide, royalty-free license to:
- Use anonymized copies of your images to train, validate, and improve machine learning models used in LuxPricer;
- Store such images and derived data for the time reasonably necessary to develop, maintain, and evaluate our models.
We will:
- Remove or minimize identifying metadata and decouple training copies from your account;
- Not sell your images to third parties;
- Not use your images for advertising purposes.
You can withdraw this consent at any time via App settings or by contacting us. Upon withdrawal, we will stop adding new images from your account to training datasets. It may not be technically feasible to fully remove historical training data already integrated into model weights, but we will not continue using new images from you for training going forward.
10. Report Sharing and Use
You may:
- Download Reports as PDF or other formats made available;
- Copy and paste content from Reports;
- Share Reports with others at your discretion.
However, you acknowledge and agree that:
- Reports are subject to the disclaimers and limitations in these Terms;
- Sharing a Report does not transform it into a certified appraisal or professional advice;
- You are solely responsible for how you share, publish, or rely on Reports.
LuxPricer is not responsible for any consequences arising from your distribution or third parties’ reliance on your Reports.
11. Intellectual Property in the Service
The Service, including all associated content and technology (other than your Content), is protected by intellectual property laws and is owned by the LuxPricer development team or its licensors. This includes, without limitation:
- Software, source code, and object code;
- AI models and algorithms;
- Design, layout, user interface, and graphics;
- Text, logos, trademarks, and service marks;
- Reports and AI outputs, to the extent generated from our models and data (excluding your raw Content).
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Install and use the App on devices you own or control;
- Access and use the Service solely for your personal or internal business purposes.
You agree not to:
- Copy, modify, reproduce, distribute, publicly display, or create derivative works from any part of the Service, except as expressly allowed (e.g., downloading your Reports);
- Reverse engineer, decompile, disassemble, or attempt to derive source code or underlying models, except where permitted by mandatory law;
- Use the outputs of the Service to develop, train, or improve competing products or services;
- Remove or alter any copyright, trademark, or proprietary notices;
- Use automated tools, bots, or scrapers to access or extract data from the Service, except as explicitly allowed by us.
12. AI-Generated Content and Accuracy Disclaimer
CRITICAL DISCLAIMER: The Service relies on machine learning and other AI techniques that are inherently probabilistic and may produce inaccurate or incomplete results.
By using the Service, you expressly acknowledge and agree that:
- Reports and outputs are generated by AI and are not expert or professional appraisals;
- We make no warranty that any estimate, description, or analysis is accurate, complete, current, or suitable for any particular use;
- No guarantee is made as to the authenticity of any item, the correctness of condition grading, or any particular resale outcome;
- Market prices and conditions can change rapidly, and our outputs may be outdated or not aligned with real-time market data;
- You use all information provided by LuxPricer at your sole risk.
You are solely responsible for any decisions you make (including buying, selling, insuring, or valuing items) based on Reports or other information provided by the Service. LuxPricer is not responsible for any financial loss, missed opportunity, or other damage arising from reliance on AI-generated content.
13. User Responsibilities and Prohibited Conduct
You agree that you will not:
- Use the Service for any unlawful, fraudulent, or unauthorized purpose;
- Upload Content that is illegal, harmful, defamatory, obscene, hateful, or otherwise objectionable;
- Upload Content containing viruses, worms, malware, or any code designed to disrupt or compromise systems;
- Attempt to gain unauthorized access to our systems, accounts, or networks;
- Interfere with or disrupt the operation of the Service or servers;
- Impersonate any person or entity, or misrepresent your affiliation;
- Use the Service to stalk, harass, threaten, or harm any person;
- Circumvent or attempt to circumvent usage limits, security controls, or access restrictions;
- Use the Service in a way that could damage, disable, or impair our infrastructure or negatively impact other users;
- Violate any applicable local, national, or international law or regulation.
We reserve the right to investigate and take appropriate action (including content removal, account suspension or termination, and reporting to authorities) if we suspect any violation of these Terms or applicable law.
14. Service Availability, Changes, and Beta Features
We aim to keep LuxPricer available and improving, but we do not guarantee uninterrupted or error-free operation.
We reserve the right, at any time and without liability, to:
- Update, modify, or improve the App or any part of the Service;
- Introduce or remove features, tools, or content;
- Offer experimental or beta features that may be unstable or subject to change;
- Temporarily suspend the Service for maintenance, upgrades, or technical reasons;
- Discontinue the Service entirely, where commercially reasonable notice is given to active subscribers.
We are not responsible for outages or performance issues caused by factors beyond our reasonable control, including third-party services, app store availability, internet connectivity, and device issues.
15. Termination and Account Deletion
15.1 Our Right to Suspend or Terminate
We may suspend or terminate your access to the Service (in whole or in part), with or without notice, if:
- You materially violate these Terms or applicable law;
- You engage in fraudulent, abusive, or harmful activity;
- You attempt to circumvent security or usage limits;
- Your subscription payments fail repeatedly or remain delinquent;
- We reasonably believe your continued use poses a risk to other users, our systems, or our business.
Upon suspension or termination:
- Your right to access the Service and use licensed materials immediately ceases;
- Any unused subscription time or credits may be forfeited, except where prohibited by law;
- We may delete your Content and account data in accordance with our Privacy Policy and data retention practices.
15.2 Your Right to Delete Your Account
You may delete your LuxPricer account at any time via the App settings or by contacting us. Account deletion will:
- Remove your ability to log in and use the Service;
- Result in deletion or anonymization of your personal data as described in our Privacy Policy;
- Not automatically entitle you to refunds for any prior subscription fees, except where required by applicable law or by app store/payment processor policies.
16. Third-Party Services and Links
The Service may interact with or reference third-party services, including:
- App stores (Apple App Store, Google Play);
- Payment processors (e.g., Paddle);
- Luxury resale marketplaces (e.g., Vestiaire Collective, Rebag, Fashionphile);
- AI infrastructure or analytics providers.
We do not control and are not responsible for:
- The content, terms, or privacy practices of these third-party services;
- Any damages or losses arising from your interactions with them.
Your use of third-party services is governed by their own terms and policies. References to third-party marketplaces or services in Reports do not imply endorsement, affiliation, or responsibility by LuxPricer.
17. Indemnification
You agree to indemnify, defend, and hold harmless Sofiya Pleshcheva, her officers, directors, employees, contractors, agents, licensors, and suppliers from and against any and all claims, demands, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:
- Your violation of these Terms;
- Your use or misuse of the Service;
- Your Content, including any allegation that it infringes or violates the rights of another;
- Any decisions or transactions you make based on Reports or other Service outputs;
- Your violation of any applicable law or regulation.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR TITLE.
- WE DO NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
- DEFECTS OR ERRORS WILL BE CORRECTED;
- THE SERVICE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
- REPORTS OR OTHER OUTPUTS WILL BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE.
- IN NO EVENT SHALL LUXPRICER OR SOFIYA PLESHCHEVA BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES;LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA;APPRAISAL INACCURACIES, FAILED TRANSACTIONS, MISSED OPPORTUNITIES, OR TRADING/RESELLING LOSSES;
- OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO LUXPRICER FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
IMPORTANT: Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under Swiss law.
19. Governing Law and Dispute Resolution
These Terms and any non-contractual obligations arising out of or in connection with them are governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law rules.
Any disputes, claims, or controversies arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland, and both parties hereby submit to the personal jurisdiction of such courts and waive any objection based on venue or forum non conveniens.
20. Changes to These Terms
We may modify or update these Terms from time to time, for example to reflect:
- Changes to the Service or business operations;
- Changes in applicable laws or regulatory requirements;
- Clarifications or improvements in our contractual language.
When we make changes:
- We will update the “Last Updated” date at the top of this document; and
- Where appropriate, we will notify you via the App, email, or other reasonable means.
For material changes (such as significant pricing changes, major feature changes, or substantial updates to liability provisions), we will, where reasonably possible, provide at least 30 days’ notice before the changes take effect.
Your continued use of the Service after the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree with the revised Terms, you must stop using the Service and may delete your account.
21. Copyright and IP Complaints
We respect the intellectual property rights of others. If you believe that any content in the Service infringes your copyright or other intellectual property rights, you may submit a notice to us containing:
- Your full name, address, and contact information (including email);
- A description of the copyrighted work or other IP you claim has been infringed;
- A description of where the allegedly infringing material is located within the Service (e.g., specific screen, URL, or screenshot);
- A statement that you have a good-faith belief that the disputed use is not authorized by the rights owner, its agent, or the law;
- A statement that the information in your notice is accurate and, under penalty of perjury (if applicable in your jurisdiction), that you are the copyright owner or authorized to act on their behalf;
- Your physical or electronic signature.

If you are located in the United States, your notice should also comply with the requirements of the Digital Millennium Copyright Act (DMCA).
22. Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be deemed severed, and the remaining provisions shall continue in full force and effect.
23. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sofiya Pleshcheva (operating as LuxPricer) regarding your use of the Service and supersede all prior or contemporaneous agreements, understandings, negotiations, and communications, whether written or oral, relating to the subject matter hereof.
24. No Waiver
Our failure at any time to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by Sofiya Pleshcheva or an authorized representative of LuxPricer.
